Carb Settlement Agreements

Senate Act 1402 (Chapter 413, 2010 Statutes) was passed on September 28, 2010 as emergency legislation and requires the ARB to publish settlement agreements on this website with SB 1402 compliance declarations. The Board of Directors and the Supervisory Board of Daimler AG and Mercedes-Benz AG approved the expected comparisons after weighing all aspects in the best interests of the company. With the proposed comparisons, the company is taking an important step towards legal certainty with respect to different modes of diesel in the United States. This page contains summaries of cases settled in lieu of disputes under the Air Resources Board`s (CARB) mutual settlement program and those that have been resolved in civil or criminal proceedings. These case documents may be available upon request, subject to exceptions to disclosure under the California Public Records Act. Transactions are subject to final approval by the relevant authorities and courts. The agreement in principle with U.S. government authorities will be remembered in binding approval orders. In the coming weeks, the authorities will submit the approval orders to a U.S. district court for final approval.

The U.S. consumer complaint is subject to U.S. District Court approval for the District of New Jersey. Daimler has informed the capital markets of the agreements in principle for compliance with the advertising obligations of the European Market Abuse Regulation (MAR). For comparisons with U.S. authorities, Daimler expects a cost of about $1.5 billion. The estimated cost of the class action is approximately $700 million, including the court`s statutory award of legal fees and fees. In addition, Daimler estimates that other expenses average tens of millions of euros to meet the requirements of comparisons.
